RULES OF PURCHASE – SALE

1. General Provisions

These Rules of Purchase – Sale (hereinafter referred to as the Rules) are a legally binding document establishing the mutual rights, obligations, terms of purchase and payment, delivery and return procedures, liability of the parties, and other regulations related to the purchase and sale of goods between the Buyer and Compaqpeat SIA (hereinafter referred to as the Seller or www.terraerden.com).

The Seller has the right to change, amend, or supplement the Rules at any time, in accordance with applicable legal requirements, including EU consumer protection legislation. Changes to the Rules apply only to orders submitted after the change takes effect. The Buyer will be informed of any material changes.

The right to use the services of www.terraerden.com is granted to legally capable natural persons; minors aged fourteen to eighteen only with the consent of their parents or legal guardians; legal entities; and authorized representatives of the aforementioned persons.

The online store www.terraerden.com conducts trade within the territory of the Baltic States: Latvia, Lithuania, and Estonia.

2. Conclusion of a Purchase and Sale Agreement

In accordance with EU Consumer Rights Directive 2011/83/EU, the agreement between the Buyer and the Seller is considered concluded from the moment the Buyer confirms the order by clicking the "Buy" or "Pay for Order" button. Before completing the purchase, the Buyer will be clearly informed of the total price including VAT, delivery costs, and any other applicable charges.

The Seller will send an order confirmation to the Buyer's provided email address without undue delay after the order is placed.

3. Buyer's Rights

The Buyer has the right to purchase goods at www.terraerden.com in accordance with the procedure established by these Rules.

In accordance with EU Consumer Rights Directive 2011/83/EU, the Buyer has the right of withdrawal — the right to withdraw from the purchase and sale agreement within 14 calendar days from the date of delivery of the goods, without giving any reason. To exercise this right, the Buyer must notify the Seller in writing by email at info@compaqpeat.com, stating the order number and the intention to withdraw.

The right of withdrawal does not apply to goods that are made to the Buyer's specifications, clearly personalized, or which by their nature cannot be returned (e.g., sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery).

If the Buyer exercises the right of withdrawal, the Seller shall reimburse all payments received, including standard delivery costs, without undue delay and no later than 14 calendar days from the date the Seller is informed of the withdrawal decision. The refund will be made using the same payment method as the original transaction.

In accordance with EU Directive 2019/771/EU on conformity of goods, the Buyer has the right to a legal guarantee of at least 2 years from the date of delivery for goods that are not in conformity with the contract.

4. Buyer's Obligations

The Buyer must accept the ordered goods and pay the stated price, including any applicable delivery charges.

If the information provided during registration changes, the Buyer must update it promptly.

The Buyer undertakes not to share their login credentials with third parties. If login details are lost, the Buyer must notify the Seller immediately at info@compaqpeat.com.

The Buyer undertakes to comply with these Rules and all applicable laws of the Republic of Latvia and the European Union when using www.terraerden.com.

5. Seller's Rights

If the Buyer attempts to undermine the operation, security, or stability of the online store, the Seller has the right to restrict or terminate the Buyer's access without prior notice or, in exceptional cases, to cancel the Buyer's account.

In exceptional circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice.

The Seller has the right to cancel an order without prior notice if payment is not received within 3 (three) business days of order confirmation.

The Seller has the right to cancel a concluded Purchase and Sale Agreement if the ordered goods are out of stock, or if the agreement was concluded by a person who did not have the right to do so under these Rules. In such cases, the Seller will notify the Buyer and issue a full refund within 5 business days.

6. Seller's Obligations

The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer, under the conditions and within the delivery timeframes communicated at the time of purchase.

If the Seller is unable to deliver the ordered goods due to unforeseen circumstances, the Seller undertakes to offer the Buyer an equivalent product. If the Buyer refuses the equivalent, the Seller undertakes to refund the amount paid within 5 (five) business days.

The Seller undertakes to clearly communicate all material information about the goods, including price, characteristics, and delivery timeframes, before the Buyer completes the purchase, in accordance with EU Directive 2011/83/EU.

7. Prices and Payment

All prices in the online store www.terraerden.com are indicated in euros (EUR) and include VAT where applicable, in accordance with the EU Price Indication Directive (98/6/EC) and the Omnibus Directive (2019/2161/EU). The total price, including delivery costs, will be clearly displayed before the Buyer confirms the order.

If a discount or price reduction is offered, the previous price (the lowest price charged in the last 30 days) will be clearly displayed alongside the reduced price, in accordance with EU law.

The Seller reserves the right to adjust prices in the event of changes to applicable tax rates.

Prices at www.terraerden.com may differ from prices in other sales channels or retail outlets.

Payment for goods is accepted via electronic banking, credit/debit card, and bank transfer. Cash and cheque payments are not accepted.

8. Delivery of Goods

Goods are delivered by the Seller or an authorized delivery partner within the Baltic States (Latvia, Lithuania, Estonia).

The estimated delivery timeframe will be clearly communicated on the product page and/or at checkout before the Buyer confirms the order. If a delay occurs, the Buyer will be notified without undue delay.

The Buyer must ensure that the delivery address provided is accurate and complete. The Seller is not liable for delays or failed deliveries resulting from incorrect address information provided by the Buyer.

Upon receipt of the goods, the Buyer must inspect them and notify the Seller of any visible damage or discrepancies at info@compaqpeat.com within 2 (two) business days.

9. Right of Withdrawal and Returns

The Buyer may exercise the right of withdrawal within 14 calendar days of delivery by contacting the Seller at info@compaqpeat.com with the order number. No reason is required.

After notifying the Seller of withdrawal, the Buyer must return the goods without undue delay and no later than 14 calendar days from the date of notification. The cost of return shipping is borne by the Buyer unless the goods are defective or incorrectly delivered.

Returned goods must be in their original condition. The Seller may reduce the refund if the value of the goods has diminished due to handling beyond what is necessary to establish their nature, characteristics, and functioning.

Refunds will be processed within 14 calendar days of the Seller receiving the returned goods or proof of return, using the same payment method as the original purchase.

10. Legal Guarantee and Conformity of Goods

In accordance with EU Directive 2019/771/EU, all goods sold are covered by a legal guarantee of at least 2 years from the date of delivery. If goods are found to be non-conforming within this period, the Buyer is entitled to repair, replacement, a price reduction, or a full refund, depending on the circumstances.

11. Privacy and Data Protection

The Seller processes personal data in accordance with the General Data Protection Regulation (GDPR – Regulation 2016/679). For full details on how your personal data is collected, used, and protected, please refer to our Privacy Policy available on our website.

By placing an order, the Buyer consents to the processing of their personal data to the extent necessary for order fulfillment and delivery.

12. Dispute Resolution

In accordance with EU Regulation 524/2013 on Online Dispute Resolution, consumers in the EU have the right to use the EU Online Dispute Resolution (ODR) platform to resolve disputes with traders: https://ec.europa.eu/consumers/odr.

All disputes shall first be resolved through negotiation. If no agreement is reached, disputes shall be resolved in accordance with the laws of the Republic of Latvia and applicable European Union regulations.

These Rules are governed by the laws of the Republic of Latvia and applicable EU legislation.
